Data protection issues arise in the context of TUPE because a buyer will want to have information about their prospective employees. At the early stages of a transfer, data should be anonymous if possible.

There is also an obligation to disclose ‘employee liability information’ (including the names of the transferring employees) at least 28 days before a transfer. You will not breach your data protection obligations when complying with this requirement.
