Employment Status

A contract should state whether the individual is engaged as an employee, worker or as a self-employed contractor. However, the terms of the contract will not be conclusive. A number of different factors need to be considered when establishing employment status, including the level of control operated by the employer; whether there is an obligation to offer and to accept work; and whether the individual has to perform the work personally.
