On-call and sleep-in workers: NMW
On-call or standby time may be working time depending on whether:
- the worker is at home or at (or near) work; and
- if they are at or near work, they have access to sleeping facilities.
On-call means “required to be available for work but not actually working”.
If on-call time is working time this means that you need to pay the worker the NMW for those hours.
