Unfair dismissal and religious discrimination (Court of Appeal judgment) - Kuteh v Dartford and Gravesham NHS Trust [CA] 14.05.19 (Unreported)

A nurse had not been unfairly dismissed when she was dismissed for gross misconduct after initiating inappropriate discussions with patients about religion and disobeying a lawful management instruction not to continue doing so. The point of principle made in Chondol v Liverpool City Council [2009] 2 WLUK 266 could be read across to cases involving issues concerning ECHR art.9: there was a distinction between the manifestation of a religious belief and the inappropriate promotion of that belief.
