The use of confidentiality agreements in discrimination cases
The Equality and Human Rights Commission has launched guidance concerning the law in relation to confidentiality agreements (often referred to as non-disclosure agreements (NDAs)) in discrimination cases. The guidance outlines good practice when using confidentiality agreements, and provides clarity on when they would be unlawful and unenforceable.
