Sexual orientation discrimination and pension rights - O'Brien v Ministry of Justice; Walker v Innospec [CA] 06.10.15

The court found there had been neither unlawful discrimination against a part-time worker nor discrimination on the grounds of sexual orientation against a civil partner arising from their respective pension provision. The EAT had correctly decided that the pension entitlements of each individual had crystallised prior to the implementation in UK law of the Part Time Workers Directive and the Framework Directive respectively.
