Police age discrimination case - Harrod v Chief Constable of the West Midlands [EAT] 08.07.15 (Unreported)

Age discrimination – Application by police forces of Police Pensions Regulations 1987 Pt A reg.19 – Forces using Regulations to achieve salary savings by forcing police officers to retire – Whether indirect discrimination. HELD employers’ appeal allowed. Since there was no way in which the Forces could have achieved their aims other than by use of A19 it was reasonably necessary to do so, and this was appropriate. The EAT also commented on the circumstances in which the application of criterion related to pensionable service would amount to direct discrimination.
