"No beards" policy and religious discrimination - Sethi v Elements Personnel Services Ltd [ET] 10.11.19 (Unreported)

The "no beards" policy of an employment agency providing temporary staff for the hospitality industry constituted indirect discrimination against a Sikh man. An agency's no beards policy could have a rational connection to its legitimate aim of complying with its clients' requirements of not supplying staff with beards, notwithstanding that such requirements constituted unlawful discrimination. However, the agency's aim could not justify a no beards policy that admitted of no exceptions for those who could not shave for religious reasons.
