McBride v Scottish Police Authority [SupCrt S] 15.06.16

Unfair dismissal - Remedies - Fingerprints officer employed by police force - Whether reinstatement appropriate - Tribunal ordering reinstatement on restricted duties - Employer's earlier appeal against reinstatement order successful - Employment Rights Act 1996 s.114(1). HELD employee's appeal allowed. The employment tribunal was not seeking to impose a contractual limitation in the reinstatement order removing the excluded duties (i.e. signing reports and attending court to give evidence) from the employee's job description. Rather it was recognising a practical limitation on the scope of her work caused by circumstances beyond her and her employer’s control
