Martineau v Ministry of Justice [EAT] 17.06.15 (Unreported)

Tribunal procedure - Jurisdiction - Employment Appeal Tribunal - Appeals by persons not party to the proceedings before the Employment Tribunal - Part time workers - discrimination. HELD that the Employment Appeal Tribunal had jurisdiction under the Employment Tribunals Act 1996 s.21 to hear an appeal from a person who was not a party to the original proceedings. However, it would have to ensure that the bringing of an appeal by a non-party would not involve an abuse of process and was not otherwise likely to obstruct the just disposal of proceedings between the parties.
