Law applicable to contractual relations; ECJ judgment re employment contract - Greece v Nikiforidis (2016) (C-135/15) [ECJ] 18.10.16 (Unreported)

Applicable law - Contracts - Reference for a preliminary ruling — Judicial cooperation in civil matters — Law applicable to an employment contract — Regulation (EC) No 593/2008 (Rome I) article 28 — Scope ratione temporis — Article 9(3) — Foreign overriding mandatory provisions — Provision of a Member State reducing public sector workers’ pay on account of the financial crisis. HELD that Regulation 593/2008, which applied to contracts entered into after 17 December 2009, did not apply to contracts concluded before that date unless, after that date, the contract was subject to an agreed variation of such magnitude that it gave rise to the creation of a new legal relationship.
