Jurisdiction in Court of Appeal employment case - Petter v EMC Europe Ltd [CA] 27.07.15 (Unreported)

A dispute between a Massachusetts company and an employee of its UK subsidiary regarding an agreement to make stock awards was one relating to the contract of employment for the purposes of Regulation 1215/2012 s.5, and the Massachusetts company was to be regarded as an "employer" for the purposes of that Regulation. The effect of the Regulation was that the English court was bound to disregard the agreement's Massachusetts exclusive jurisdiction clause, assume jurisdiction, and grant an anti-suit injunction.
