Jurisdiction: conspiracy claims and the Lugano Convention - Arcadia Petroleum Ltd v Bosworth [CA] 19.08.16 (Unreported)
The English court had jurisdiction over claims of conspiracy brought by group companies against the former chief executive and chief financial officer of the group; the claims were not "matters relating to individual contracts of employment" within the Lugano Convention art.18. However, allegations of breaches of fiduciary duty occurring during periods when the former employees had been employed by one of the group companies would be within art.18 and the jurisdiction of the courts of Switzerland where the former employees were domiciled.http://www.bailii.org/ew/cases/EWCA/Civ/2016/818.html
