Interim injunction against psychiatrist's disciplinary hearing - Ardron v Sussex Partnership NHS Foundation Trust [QBD] 18.06.18 (Unreported)

An NHS Trust was restrained from proceeding with a disciplinary hearing against a consultant psychiatrist who was facing allegations of gross misconduct which could result in her summary dismissal. It was arguable that the alleged conduct might not on its face amount to gross misconduct and such an incorrect categorisation provided a sufficient basis for an injunction pending the resolution of her claim that a failure to properly apply the Trust's Disciplinary Policy and Procedure breached her employment contract.
