Indirect sex discrimination and shared parental leave - Hextall v Chief Constable of Leicestershire [EAT] 01.05.18 (Unreported)

An employment tribunal had erred in finding that a male employee had not been subject to indirect sex discrimination by reason of his employer's policy of not paying those on shared parental leave at the same rate as a woman on maternity leave. Having rejected, for the purposes of a direct discrimination claim, the contention that women on maternity leave were valid comparators for men on shared parental leave, the tribunal had erred in applying that finding as a reason for rejecting the indirect discrimination claim.
