Indirect age discrimination in teaching scheme: proportionality - Re Early's Application for Leave to Appeal for Judicial Review [QBD (NI)] 19.05.17 (Unreported)

A scheme which attempted to rebalance the teaching workforce by assisting recently qualified teachers to obtain permanent teaching posts constituted indirect age discrimination contrary to EU law as teachers who had been qualified for longer, and were usually older, were excluded from applying for posts under the scheme. However, the discrimination was justified as the scheme was a proportionate means of achieving a legitimate aim.
