Holiday pay should include commission payments
The European Court of Justice has issued its much anticipated decision in the case of Lock v British Gas Trading Limited. As many predicted, the court held that commission payments must be taken into account when determining holiday pay.
Although this case only refers to commission payments, other types of payments, such as overtime, may have to be treated in the same way – if they are ‘linked intrinsically to the performance of tasks which the worker is required to carry out’ under the contract.
