European Convention on Human Rights art.11 and the recognition of non-independent trade unions - R. (on the application of Boots Management Services Ltd) v Central Arbitration Committee [CA] 10.02.17 (Unreported)

The statutory scheme which allowed an employer's recognition for certain limited purposes of a non-independent trade union to prevent an independent union from obtaining recognition was not incompatible with the ECHR art.11. The Trade Union and Labour Relations (Consolidation) Act 1992 Sch.A1 gave workers the right to secure the derecognition of such a non-independent trade union and prevented a breach of their art.11 rights.
