ET's role after witdrawal of party from proceedings - Campbell v OCS Group UK Ltd [EAT] 11.04.17 (Unreported)

Employment tribunals were not required to invite representations from the parties before dismissing proceedings after a withdrawal. However, if it appeared that the party seeking withdrawal intended to issue fresh proceedings, or if the decision to withdraw was irrational or ill-considered, it was open to the tribunal to make further enquiries of the withdrawing party before making a dismissal decision.
