ET decision in Asda equal pay case - Brierley v Asda Stores Ltd [ET] 13.10.16 (Unreported)

In the course of their claims for equal pay, 7,000 retail workers were allowed to use their employer's distribution depot workers as comparators where TFEU art.157 was directly effective and the differences in their pay conditions were attributable to a single source. Further, the adoption of different language in the Equality Act 2010 s.79(4) in place of the Equal Pay Act 1970 s.1(6) had not repealed the hypothetical "relevant classes" test as a means of comparison.
