Employment tribunal rules and the ECHR: Court of Appeal judgment - Kiani v Secretary of State for the Home Department [CA] 21.07.15 (Unreported)

The Employment Appeal Tribunal had properly applied the principles in Tariq v Home Office and ZZ (France) v Secretary of State for the Home Department, when finding that exclusion and non-disclosure orders made under the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004 Sch.1 para.54 complied with article 6 of the European Convention on Human Rights. There was no material difference in the general approach of EU law and Convention law in relation to such an important issue of procedural justice.
