ECJ obesity dismissal case - Fag og Arbejde (FOA) v Kommunernes Landsforening (KL) (C-354/13) [ECJ] 18.12.15 (Unreported)

Reference for a preliminary ruling — Social policy — Dismissal — Grounds for dismissal — Obesity of the worker — General principle of non-discrimination on grounds of obesity — No such general principle — Directive 2000/78/EC — Equal treatment in employment and occupation — Prohibition of any discrimination based on a disability — Whether a ‘disability’ exists. HELD that EU law did not lay down a general principle of non-discrimination on grounds of obesity as such as regards employment and occupation. However, the obesity of a worker may constitute a disability within the meaning of Directive 2000/78.
