ECJ judgment on freedom to provide services and posted workers - Cepelnik d.o.o. v Vavti (2018) (Case C-33/17) [ECJ] 13.11.18 (Unreported)

Reference for a preliminary ruling — Article 56 TFEU — Freedom to provide services — Restrictions — Services in the internal market — Directive 2006/123/EC — Labour law — Posting of workers in order to carry out construction works — Reporting of workers — Retention and translation of payslips — Suspension of payments — Payment of a security by the recipient of the services — Surety for a possible fine to be imposed on the service provider. HELD that national legislation requiring a recipient of services to provide security in order to secure a fine that might be imposed on a service provider established in another Member State for breach of a provision of national labour legislation was contrary to the EU freedom to provide services.
