EAT decision re costs capping orders - Kuwait Oil Co (KSC) v Al-Tarkait [EAT] 04.12.19 (Unreported)

When making a costs order under the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 Sch.1 para.78(1)(b) and imposing a cap on the amount of costs recoverable, the employment tribunal should preferably specify the cap as an exact sum rather than an approximation. However, an order which limited the costs payable to "the maximum sum of compensation awarded to the claimant added to the costs awarded to the claimant" was within the tribunal's powers; it did not usurp the jurisdiction of a judge conducting a subsequent detailed assessment.
