EAT decision on temporary agency workers - Coles v Ministry of Defence [EAT] 31.07.15 (Unreported)

Temporary agency workers - Interpretation of relevant legislation - Advertising of vacant posts. HELD that the Agency Workers Regulations 2010 reg.13 gave temporary agency workers the right to be informed of relevant vacant posts at the end-user's undertaking; it did not confer a right to apply or be interviewed for any particular post. When recruiting for a vacant post, an employer was entitled to give preference to permanent employees who were at risk of redundancy over temporary agency workers.
