EAT decision on deposit orders - Adams v Kingdom Services Group Ltd [EAT] 11.12.19 (Unreported)
When ordering a claimant to pay a deposit to proceed with their claim, employment tribunals were required under the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 Sch.1 para.39(3) to give reasons not only for why the order was made but also for the particular amount ordered to be paid. Even if that conclusion was wrong, tribunals were obliged to provide adequate reasons as a matter of general principle, which included explaining how a party's means had been taken into account in fixing the deposit sum.
