Disability discrimination and pay protection - G4S Cash Solutions (UK) Ltd v Powell [EAT] 26.08.16 (Unreported)

Disability discrimination – Reasonable adjustments – Pay protection. HELD that there was no reason in principle why the Equality Act 2010 s.20(3) should be read as excluding a requirement upon an employer to protect an employee's pay to counter his disadvantage through disability. In a case where an employee became disabled and was therefore unable to perform his previous duties, his employer was required to make the reasonable adjustment of employing him in a new role without reducing his salary.
