Diplomatic immunity question in trafficking case - Basfar v Wong [EAT] 31.01.20 (Unreported)

The current state of the law regarding whether a diplomat's alleged activities in trafficking a domestic servant and holding her in conditions of modern slavery constituted "commercial activity... outside his official functions" within the Vienna Convention on Diplomatic Relations 1961 art.31(1)(c) was represented by the Court of Appeal's decision in Al-Malki v Reyes [2015] EWCA Civ 32, [2016] 1 W.L.R. 1785, [2015] 2 WLUK 170, [2015] C.L.Y. 813 and the obiter comments of the Supreme Court minority on that issue in the same case.
