Data to be used in monitoring exercise to assess junior doctors' rest breaks - Hallett v Derby Hospitals NHS Foundation Trust [CA] 30.07.19 (Unreported)
An NHS Foundation Trust had not been entitled to use expected or substitute data, as opposed to actual recorded data, when carrying out a monitoring exercise to assess whether junior doctors were taking the required rest breaks. If actual data had been used, the Trust would have been in breach of the rest break requirements, and the junior doctors would have been entitled to a pay supplement.http://www.bailii.org/ew/cases/EWCA/Civ/2019/1394.html
