Court of Appeal judgment in agency workers case - London Underground Ltd v Amissah [CA] 19.02.19 (Unreported)

The Court of Appeal summarised the effect of the Agency Workers Regulations 2010 in relation to the compensation that would be payable to workers who were paid less than the hirer's permanent employees. It discussed the interrelationship between the liability and apportionment provisions in reg.14 and reg.18(9) and concluded that while it could be just and equitable to require a hirer or agency to pay a claimant less than the amount of compensation for which it was "responsible", such cases would be exceptional and were likely to involve serious misconduct on the part of the claimant.
