Clause giving "Scottish courts and tribunals" exclusive jurisdiction: relevance in assessing closeness of connection to UK - Hexagon Sociedad Anonima v Hepburn [EAT] 13.11.19

In the first appellate case considering the relevance of a clause giving the Scottish courts and tribunals exclusive jurisdiction, the EAT has held that the existence of such a clause in the employment contract of an employee working in Equatorial Guinea was a relevant factor in determining whether the UK had jurisdiction to hear employment claims, provided there were other connections independently connecting the claim to the UK.
