Age discrimination and Probation Service pay - Heskett v Secretary of State for Justice [EAT] 25.06.19 (Unreported)

The introduction of a new pay progression policy by the Ministry of Justice in respect of the Probation Service, which increased from eight years to 23 years the time needed for probation officers to progress from the bottom to the top of the pay band, was prima facie discriminatory on the ground of age because older employees near the top of the band would earn significantly more than those lower down the band. The policy was, however, justified as a temporary measure, because its aim was not simply to cap pay, but to enable the Probation Service to live within its means against a background of central government cuts. The tribunal had been entitled to point out that unless changes were made to the policy in the near future, the outcome of a further complaint might be different.
