Settlement: The Best Route?

In a settlement agreement, an employee waives their right to make a claim against you in relation to specific matters covered in the agreement. This will usually be in exchange for a payment from you. Settlement agreements can be used in various circumstances, and can be a useful tool, but will not always be the best option: in some circumstances it will be more appropriate to follow a formal process, such as a disciplinary or capability process; in other cases certain factors can outweigh good employment practice making it beneficial to dismiss quickly, without first agreeing settlement or following your usual process.
