Maternity Pay: Entitlement

Not all employees who are entitled to maternity leave will be entitled to statutory maternity pay (SMP). To qualify for SMP employees must meet certain conditions, including having 26 weeks’ continuous employment as at the qualifying week and a minimum level of earnings. They must also give notice of their intended start date for SMP and provide medical evidence relating to their pregnancy. If an employee does not qualify for SMP, you need to confirm this to her within a set time and provide her with an SMP1 form.
