Dismissal: Loss of Driving Licence
If you want to take action because an employee has been disqualified from driving, you should decide on the most appropriate basis for your action. Depending on the circumstances, this might be because their continued employment would breach a statutory duty or restriction; they lack the necessary qualifications for their role; misconduct; or for ‘some other substantial reason’ such as damage to your reputation. It will not be automatically fair to dismiss for any of these reasons and to avoid a claim of unfair dismissal you will need to follow a fair procedure and act fairly and reasonably overall.
