Misconduct Outside of Work

If you are taking disciplinary action this will usually be on account of an employee’s behaviour at work but in some circumstances you can take action in respect of conduct outside of work. Take care to identify the reason why you are taking action: if conduct occurs outside the workplace it may not always be appropriate to take action on the basis of ‘misconduct’ but you may have other legitimate grounds for taking action, such as reputational damage.
